TDS is not yet another tax. This is money received by the person writing the cheque. The statute enumerates the situations for tds. Miss a situation and the deductee’s 26AS remains blank while department still wants the tax from you.
The Income-tax Act, 2025 provides for salary withholding in Section 392 and for almost all other withholding in Section 393 tables, effective 1 April 2026. Old labels (192, 194C, 194J, 194I) are still the language of the language staff. Returns must quote the new table entry.
Quick Answer Box
Deduct when you credit or pay a covered sum, whichever is earlier, if the annual (or per-transaction) threshold is exceeded. Deposit by the due date, typically the 7th of the following month. File a quarterly report. No PAN on payee means usually higher rate. Check live rates on department chart before locking payroll.
When TDS Is to Be Deducted
The trigger is the earlier of:
- credit to the payee’s account (including a suspense or payable ledger), or
- actual payment
A credit already booked doesn’t get held up waiting for the vendor to “invoice next month”.
Thresholds are usually per payee per year (sometimes per contract, sometimes per month [rent paid by specific people]). The obligation applies to that payment under the appropriate clause. Go over the line on the 11th invoice.
Identity of deductor matters. Many clauses offer relief to individuals and HUFs who were not liable to tax audit in the preceding year. The courtesy does not extend to salary, property purchase, specified individual rent and payments to non-residents.
No TAN, no legal machinery for deduction for a business that needs one.
On Which Items TDS Is Applicable
Everyday resident-payee situations (legacy names first, then the 2025 home):
- Salary (old 192 / s. 392): slab rates, including perquisites
- Interest other than securities (194A / 393): bank, company and many deposit interests above the clause threshold
- Dividends (194 / 393)
- Contractor or job work (194C / 393): 1% or 2% style rates once single-contract or aggregate limits trip
- Commission or brokerage (194H / 393)
- Rent of plant versus land/building/furniture (194I / 393), and the separate individual/HUF monthly-rent clause (194IB)
- Professional fees at the higher rate and technical / call-centre fees at the lower rate (194J / 393)
- Director remuneration (often no threshold)
- Purchase of immovable property other than agricultural land (194IA)
- Purchase of goods by a large buyer (194Q)
- E-commerce operator to participant (194O)
- Business benefits or perquisites (194R)
- Virtual digital assets (194S)
- Partner remuneration / interest where the new partner-payment clause applies
- Cash withdrawals from banks above the 194N bands
- Payments to non-residents (195 / 393 non-resident table), DTAA only with papers
TCS is a cousin collected by the seller on certain receipts. Do not code TCS as TDS in RPU.
Finance Acts change the rates and rupee thresholds. Multiple 2026 charts indicate professional-fee thresholds around ₹50,000, contractor dual limits, 194Q at 0.1% post-₹50 lakh for buyers who passed the turnover test and individual rent at 2% after monthly rent crosses ₹50,000. Think of any number in a blog as a map. The department table takes the cake.
Higher deduction (often 20%) if PAN is not furnished by the payee, subject to the exact clause.
Common Situations Where TDS Applies in India
- Monthly payroll and full-and-final settlement.
- Office or warehouse rent to a company landlord.
- House rent paid by an individual above the monthly 194IB line.
- CA, lawyer, architect or consultant retainers.
- Software support billed as technical services.
- Interior contractor versus interior designer (194C versus 194J is a facts test).
- Agency commission on sales.
- Buying a flat above the property threshold.
- A company with prior-year turnover above the 194Q gate buying goods from one vendor beyond ₹50 lakh.
- Marketplace payout to a seller.
- Paying a US designer from an Indian company (non-resident table plus Form 15CA/15CB where required).
Each line is a situation. The ledger name is not.

When to File TDS
Two clocks:
Deposit of tax
most deductors by the 7th of the following month. March often has a special year-end date. Property and some individual-rent challan-cum-statements have their own 30 day style clocks.
Quarterly statement
- Q1 (Apr–Jun): 31 July
- Q2 (Jul–Sep): 31 October
- Q3 (Oct–Dec): 31 January
- Q4 (Jan–Mar): 31 May
Forms in transition language. 24Q for salary. 26Q for resident non-salary. 27Q for non-residents. The 2025 Act provides for successor form numbers (commentaries refer to Form 138 / 140 / 144). Use the utility provided by the portal for that quarter.
Accept statement and issue Form 16 (salary) / Form 16A (others) within prescribed window.
A daily fee will be applied for late filings. Wrong challan identifiers lead to defaults not matching 26AS.
How to File TDS Returns Using Popular Online Tax Platforms
- Obtain TAN and register on TRACES (tdscpc.gov.in) and the e-filing portal.
- Deduct and deposit with a correct nature code and CIN.
- Pull data from payroll or accounting software, or type it into NSDL’s Return Preparation Utility.
- Validate to an .fvu file.
- Upload on TRACES or the e-filing TDS path.
- Store the provisional receipt.
- Download Form 16 / 16A after processing.
Winman, Spectrum, Taxmann utilities, Excel of house and Clear, Saral are used by CA firms. The portal still needs an FVU matching challans.
You tagged the wrong PAN. Correction statements are available. They don’t negate a deduction you missed.
Which Financial Software Can Help Calculate TDS?
Tools that reduce, not replace, judgement:
- Tally, Zoho Books, Busy, Marg with TDS masters
- Payroll: GreytHR, Keka, Darwinbox, SAP SuccessFactors
- Dedicated TDS: ClearTDS, TaxCloud-class products, CA RPU suites
They apply the rate you have mapped to the ledger. You coded a lawyer as a contractor . The software will withhold the contractor rate with perfect confidence .
197) Old Lower Deduction Certificates must be loaded manually. Non-resident DTAA rates need to be loaded manually.
Automated TDS Compliance for Small Businesses
Automation that is honest:
- Vendor PAN validation
- Threshold trackers per PAN
- Challan–invoice matching
- Reminder for the 7th
- RPU export
Automation that is marketing:
- “Never think about 194J versus 194C again”
- Filing without TAN login
- Ignoring the audit-liability test for individuals
Outsourced CA retainers plus software beat a bot that files a blank 26Q.
Situations Requiring TDS on Rental Income, Managed Digitally
Two rent worlds:
Business tenant (194I style)
Land/building/furnishings at the building rate; plant and machinery at the lower rate once the annual threshold for that clause is reached. Deduct, deposit, put the line on the quarterly non salary return.
Individual / HUF tenant not in the audit net (194IB style)
Deduction of 2% on monthly rentals above ₹50,000 (see live table) Compliance is often a challan cum statement ( old 26QC) rather than full 26Q life. Now, some tax apps and banks allow you to create that challan from the rent contract itself.
Digital hygiene: Keep rent agreement, landlord PAN, monthly UTR and challan PDF in one folder. Credit should be shown in landlord’s 26AS. If not, your CIN is incorrect.
The NRI landlords have put the non-resident withholding overlay. The resident rent code is not used because the flat is in Pune.
TDS Issues That Recur
- Credit in March, payment in April: which Act year? The earlier event governs.
- GST in the invoice: follow the clause on whether GST is part of the base.
- Reimbursement of pure cost versus fee.
- Advance paid before work starts.
- Joint payees and one PAN.
- Quoting 194C on an April 2026 payment and watching the portal reject the nature code.
Table 2: Generic Advice vs. Strategic Thinking Matrix
| Decision Point | Generic Advice | Strategic Thinking |
| “Software will deduct” | “Set and forget” | Map nature of work first |
| Rent ₹45,000 a month | “No TDS ever” | Watch 194IB if it crosses ₹50,000 |
| Consultant on labour supply | “Always 194J” | Facts may be 194C |
| Filed 26Q | “Done for the year” | Form 16A still due |
| No vendor PAN | “Deduct 10%” | Higher-rate clause may be 20% |
| NRI landlord | “Same as resident 194I” | Non-resident table |
Strategic thinking dates the credit and names the payee.
Closing Perspective
TDS situations are payment stories: who gets paid, for what, how much this year and if the payer is in the clause. The house numbers, more than the furniture, changed with the 2025 Act. Give the certificate, file the quarter, deposit on time, deduct at credit or payment. The software keeps the arithmetic honest once a human has selected the nature code.
This information is general. Use the live Section 392/393 tables and a CA for the return you sign.
