Recognition is not the holiday. 80iac of income tax act is a three-year profit deduction that starts only after a second certificate.

Quick Answer Box

100 percent of the profits of an eligible business for any three consecutive years during the first 10 Company or LLP. 2. Incorporated on 1 April 2016 to before 1 April 2030. Claim turnover of Rs.100 crore and below. Requires certificate from the Inter-Ministerial Board. Only 2 old regime. DPIIT is not enough alone.

What the Section Gives

What are the key benefits of 80IAC of Income Tax Act?

If the conditions are satisfied, the startup can claim deduction of 100 percent profits and gains of the eligible business for three consecutive assessment years. The three years are chosen by the assessee from the ten years beginning with the year of incorporation.  It is not “any three years”. They must be adjacent. Even a loss year in the middle still gets a slot.

Eligible business means innovation, development or improvement of products, processes or services, or a scalable model with high potential for employment or wealth creation. Just having a Startup India login does not make a trading outfit eligible.

This section applies the audit and computation conditions of Section 80-IA. Without the audit required by the Act, the claim is a claim that can be denied.

Who Qualifies

Section 80 iac of the income tax act, in the Explanation:

  • Company or limited liability partnership; Even if DPIIT now recognises more entity types, this section is not a partnership firm or a cooperative.
  • Incorporated on or after 1 April 2016 but on or before 1 April 2030.
  • The total turnover of the business for the preceding year for which the deduction is claimed, does not exceed ₹100 crore.
  • It has a certificate of eligible business from the Inter-ministerial Board of Certification.

In its February 2026 notification, the DPIIT increased the cap of recognition turnover (₹200 crore in general, ₹300 crore for deep tech) and extended the deep-tech window. That is the rule of recognition. Separate test is the 100 crore line for 80-IAC, the Act. A startup can be recognised, and still be over the deduction cap in the year it wants the holiday.

How a Startup Claims It

How can startups claim deductions under 80IAC of Income Tax Act?

  1. Incorporate as a private company or LLP in the window.
  2. Get DPIIT recognition on the Startup India / NSWS path.
  3. Apply to the Inter-Ministerial Board in Form-1 with the documents that form names, for a certificate of eligible business. Recognition does not file this for you.
  4. Once certified, choose the three consecutive years and claim the deduction in the return, with the 80-IA-style audit.
  5. Stay inside ₹100 crore turnover in each claim year.

What documents do I need to submit for 80IAC tax deduction claims?

For the Board: Form-1 and the pitch, financials and innovation evidence that form asks. For the return: the IMB certificate, the computation that isolates eligible-business profits, and the audit report the section imports from 80-IA. A DPIIT PDF in place of the Board certificate is the claim that fails.

What It Is Not

80ic of income tax act is a separate deduction, for certain undertakings in special category states, with its own sunset and conditions. DPIIT startup and a Himachal unit are not same file.

Section 81 of the GST act is a GST provision relating to transfer of business. It has nothing to do with this income-tax holiday.

So, chapter is what is section 80 in income tax. It has different sections such as 80C, 80D, 80-IAC etc. There’s no “Section 80 deduction.”

The new tax regime does not allow this Chapter VI-A claim. A startup that opts for the new regime gives up 80-IAC for that year. The holiday is an old-regime computation.

The existing mapping states that the Income-tax Act, 2025 will be having this holiday in Section 140 from April 1, 2026. For the year still under the Act of 1961 the number on the form is 80-IAC. Before responding to a notice, check the live section.

Software and Advisers

Which tax filing software supports 80IAC deductions automatically?

Utilities may have a Chapter VI-A number. None of them can see an IMB certificate that you don’t have or share profit from eligible business with other income. “Automatic” means the field is present. It does not mean the deduction is valid.

Can I get professional help to maximize 80IAC benefits for my startup?

A chartered accountant or a tax counsel can time the three years, keep the audit, and stop a claim in a year the turnover has crossed ₹100 crore. Maximising is choosing the three profitable consecutive years. It is not inventing a fourth year or using the new regime and the deduction together.

Closing Perspective

Section 80-IAC 100% deduction for three consecutive years out of Ten for certified company or LLP under turnover cap. DPIIT has opened the door. The Inter-Ministerial Board is the discount. The new regime closes it. 80-IC and GST section 81 are other statutes. Software records a number. It does not create the holiday.

This is general information, not a startup opinion.
