The act you were quoting is gone. The arithmetic that most people use is still valid. New gratuity rules for private sector employees mean the Code on Social Security, not a new 15/26.
Quick Answer Box
Gratuity is covered by Chapter V of the 2020 Social Security Code as of November 21, 2025. Five years for regular staff, followed by a last drawn basic plus DA × 15/26 × years. The five years are skipped in cases of death and disability. Pro-rata pay is available to fixed-term employees without waiting. The lowest actual, formula, and lifetime tax exemption is ₹20 lakh for the private sector. The payout is not a website calculator.
What the New Rules Are
What are the new gratuity regulations in India for workers in the private sector?
On November 21, 2025, the Central Government implemented the labour codes. The 1972 Payment of Gratuity Act was abolished. The Code now includes gratuity in sections 53 to 58. If you leave before that date, the old Act still applies.
For a typical employee, what did not flip?
- due upon retirement, resignation, or superannuation following continuous service.
- The standard qualifying period is still five years.
- The five years are still waived in the event of death or disability brought on by an illness or accident. The nominee receives payment.
- For a covered establishment, the formula is still 15 days’ wages for each full year, calculated as 15/26 of the most recent wages.
- According to the Code’s wage definition, basic pay, dearness allowance, and retaining allowance are considered wages for this purpose. The foundation is not CTC, HRA, or a performance bonus.
In practice, what did change?
- Fixed-term jobs are acknowledged. Without the five-year requirement, a fixed-term employee is eligible for a pro rata gratuity. Eligibility after a year on that contract is indicated by ministry guidelines following the codes.
- The definition of wages is consistent. If wages are reconstituted, a company that has parked the majority of its CTC outside of the basic component may see its base shift.
- Forms and regulations from the state are being announced gradually. Your establishment’s process may lag behind the Central text.
The amount of forfeiture for proven misconduct of the types listed in the Code may still be reduced or eliminated. It doesn’t happen automatically.
How to Calculate
How can I calculate gratuity under the updated private sector rules?
For a covered employee:
Years: a part over six months counts as one more year. Twelve years and eight months is 13. Twelve years and four months counts as 12.
Example: basic plus DA ₹50,000, 10 years.
50,000×15×10/26=₹288,462.50×15×10/26=₹288,462.50×15×10/26=₹288,462.
That is the statutory figure, subject to the ceiling in section 53(3) and to any higher amount the employer’s own scheme pays. A higher scheme does not raise the tax exemption.
Employees of establishments not covered by the Code use a different tax formula: half a month of the average salary of the last ten months times completed years, with no six-month round-up. That is a tax-computation split, not a reason to skip a covered employer’s duty.
Tax
Private-sector exemption under Section 10(10) is the least of:
- Gratuity actually received
- The formula amount
- ₹20 lakh
The 20 lakh is a lifetime limit across employers. Exemption means ₹ 8 lakh left at next job. Earlier job used ₹ 12 lakh. Amount above exempt slice is salary, taxed at slab. Tax impact can be spread via Form 10E for section 89 relief. It does not increase the exemption. Government employees receive a different, broader exemption. Heirs of a deceased employee are not generally liable for this tax.
The exemption is available on retirement, resignation, death or disablement and not on a mid-service ‘ex gratia’ labelled gratuity.
Software, Calculators, Vendors
Which payroll software supports the latest gratuity regulations for private companies?
A serious payroll or HR system can store basic, DA, date of joining & date of exit and run 15/26. The software brand is not the company’s form and the payment. Compliance is. There is no government-certified “best gratuity software.
Are there any online gratuity calculators for private sector employees?
Yes, lots of them. They are guesstimates. They do not know your wage definition, a past forfeiture, a fixed-term contract or how much of the ₹20 lakh you have used. Use one to check a full and final sheet. Do not take it as a statement.
What companies offer gratuity management services compliant with new private sector laws?
Employers’ funds are managed by actuaries, insurers, and payroll processors. They are suppliers to the company. To qualify, an employee does not purchase a “gratuity service”. Eligibility is the Code and the exit.
Table 1: Financial & Technical Data Matrix – Who Gets What
| Case | Five years? | Formula base |
| Regular resignation | Yes | Basic + DA, 15/26 |
| Death or disablement | No | Same formula, service done |
| Fixed-term, Code | No, pro-rata from 1 year | Same idea, on that contract |
| Not covered, tax only | As the scheme | Half-month, last 10 months |
Risk Analysis: Eleven Gratuity Errors
- Quoting the 1972 Act for an exit after 21 November 2025.
- Counting CTC instead of basic plus DA.
- Ignoring the six-month round-up.
- Treating ₹20 lakh as the payout cap rather than the tax cap.
- Forgetting a prior employer already used part of the exemption.
- A fixed-term employee accepting “no five years, no gratuity.”
- Trusting a public calculator over the full-and-final.
- Buying a “gratuity management” product as an individual.
- Missing the nomination, so the family waits.
- Assuming forfeiture without the Code’s process.
- An NRI taxing the whole sum in India and again abroad without a credit check.
Table 2: Generic Advice vs. Strategic Thinking Matrix
| Decision Point | Generic Advice | Strategic Thinking |
| Law | “1972 Act” | Code, Chapter V, from Nov 2025 |
| Calculator | “The website number” | Employer’s computation |
| Tax | “Always tax free” | Least of three, ₹20 lakh life |
| Software | “Best payroll brand” | Correct wage and dates |
| Fixed-term | “Nothing before five years” | Pro-rata under the Code |
Strategic thinking reads the appointment letter and the full-and-final against the Code, not against a CTC screenshot.
Closing Perspective
The new gratuity rules have brought the statute into the Code on Social Security. The five year rule and the 15/26 formula remain for the regular private sector staff. Temporary staff have a shorter door. Tax on career earnings up to ₹20 lakh. Software and calculators calculated. The company pays what the Code requires.
This is general information and not a claim calculation.

The Payment of Gratuity Act was repealed. Gratuity is now Chapter V of the Code on Social Security, from 21 November 2025.
How do I calculate it?
Basic plus DA, times 15, times years, divided by 26. Round a part-year over six months up.

It can compute. It does not replace the employer’s duty. There is no official best product.
Are online calculators accurate?
They are estimates. The full-and-final is the figure.
Who manages the fund?
The employer, sometimes through an insurer or actuary. An employee does not buy eligibility.
How can WealthMunshi help?
Not as a labour authority. Tax Planning on the Exempt Part and Form 10E with the help of WealthMunshi.
A full-and-final CTC will not correspond to the Code. If a private employee leaves his job, he can get his gratuity and tax clearance done before signing the settlement.
