Banks want a legal heir certificate. Relatives say there is a WhatsApp chart. The statute only asks whether the decedent left a valid will. If the answer is no, then the person died intestate. The estate then follows a printed order which may not be liked by the family. That is what dying intestate means under Indian law.
Quick Answer Box
Intestate = no valid will exists. The religion of the deceased chooses the statute. A Hindu wife’s estate is not identical to a Hindu husband’s Class I list. Children and husband. If both are gone, the husband’s heirs generally come before her parents, except in cases where Section 15(2) sends inherited property back up the line. An unsigned PDF that was drafted is still intestacy.
Died Intestate Meaning in Law
To die intestate is to die without a will that the court will consider valid. Partial intestacy is where the will disposes of some property but not all of it or a gift in the will fails.
A nominee is a receiving hand on a bank account, mutual-fund folio or insurance policy. Nomination does not alter succession law. Once the institution pays the nominee, the statutory share of heirs can still be claimed.
In case of no will, survivor(s) can collect through letters of administration (or succession certificate for certain debts and securities) which are the court papers. They are slower than the probate of a clean will, and they follow the intestate list.
What Happens When Someone Dies Intestate in India?
Three questions, in order:
- Which personal law applied to the deceased?
- Which assets are self-acquired, inherited, coparcenary or jointly held?
- What will each holder (bank, registrar, depository, employer) accept as proof?
Religion normally chooses the law, not the flat city. 3. Members of Scheduled Tribe may be subject to custom unless brought into the Hindu Succession Act. The Special Marriage Act has to be re-read in light of inter-faith marriages.”
Not every Indian District requires probate of every asset in a Will. Intestacy nearly always means a paper chase.
Dying Intestate Who Inherits: Hindu Male
For a Hindu, Buddhist, Jain or Sikh male, Section 8 and the Schedule direct self-acquired property first to Class I heirs as a group. Class II is omitted.
Class I includes the widow, sons, daughters, mother and designated descendants and widows of predeceased children. They eat together. If children or mother is alive, widow does not take whole estate. After the amendment in 2005, daughters are like sons. This includes the coparcenary of a joint family after Vineeta Sharma.
Class II (father, brothers, and a long list of more distant relatives) inherit only if there are no heirs in Class I.
Coparcenary property is separate share . The undivided share of the man in HUF property still goes by succession but the surviving coparceners have their own shares.
Female Dying Intestate: Hindu Succession Act
A Hindu woman’s property is not distributed on the male Class I chart. Sections 15 and 16 set a different ladder.
Section 15(1) order (each earlier group excludes the next):
- Sons, daughters (including children of a predeceased son or daughter) and the husband
- Heirs of the husband
- Mother and father
- Heirs of the father
- Heirs of the mother
That’s why a childless widow’s self-acquired flat can go to her late husband’s relatives before it goes to her own parents. The structure has received criticism and has been the subject of Supreme Court action as of reporting in 2026. So section 15 is the map, until the statute changes.
Section 15(2) source rule, if she leaves no son, daughter or descendants of either:
- Property she inherited from her father or mother goes to the heirs of the father, not down the 15(1) list
- Property she inherited from her husband or father-in-law goes to the heirs of the husband
Self acquired salary savings, a flat purchased in her name from her earnings and gifts that are not “inherited” remain on the 15(1) ladder. The title source is therefore a fact to be proved and not assumed.
Section 14 already makes absolute the estate of a Hindu woman. Intestacy does not revive old limited estate. It just takes the next owner.
If a Wife Dies Intestate Who Inherits?
Depends on her personal law and on who is alive.
Hindu wife
- Surviving husband and children: they take together under Section 15(1)(a). He does not swallow the children’s shares.
- No children, husband alive: he takes the 15(1)(a) estate (subject to 15(2) on inherited parcels).
- No children, husband already dead: heirs of the husband generally stand before her parents for self-acquired property.
- Natal inherited house, no children: father’s heirs under 15(2)(a).
Christian or Parsi wife (Indian Succession Act)
The core intestacy scheme treats the widower symmetrically to a widow. If there are children, the surviving spouse normally gets one-third and the children share two-thirds. If there are collaterals but no children, the spouse will often get half. If there is none, the spouse may take the whole. Parsi provisions have a timetable of their own. Read the Applicable Part.
Muslim wife
Fractions determined by Shariat (Sunni or Shia school as applicable). A husband is a sharer. His proportion depends on children, parents and others. A will normally cannot give away more than one-third of the net estate without the consent of heirs. The rest is intestate.
There is no Indian law that says “the husband everything” as a slogan.
Table 1: Financial & Technical Data Matrix – Who Stands First
| Deceased | First takers (typical) | Watch-out |
| Hindu man | Class I together | Widow shares with children and mother |
| Hindu woman | Children + husband | Then husband’s heirs before her parents |
| Hindu woman, inherited from father, no children | Father’s heirs | 15(2)(a) |
| Christian / many ISA estates | Spouse + children | Spouse often one-third if children exist |
| Muslim | Quranic / school shares | One-third will cap |
How Can I Find Legal Help for Dying Intestate Cases Near Me?
- A civil lawyer who files succession and administration petitions in the district where the assets sit
- State legal services authority clinics for families who qualify
- The bank’s deceased-claim desk for deposits under the simplified RBI thresholds, which still need heir papers
- A CA only for tax on the estate, not for title
“Near me” one could approach the registrar and the civil court which can grant heirship or administration papers in case of immovable property. The Indian flat is still in the Indian court of an NRI heir.
Don’t pay a tout for a ‘legal heir certificate’ issued by no tehsildar..
Which Online Services Assist with Intestate Succession Documentation?
Useful online work:
- Drafting an affidavit of legal heirs
- Checklists for bank deceased-claim forms
- Scanning title deeds and death certificates
- Connecting to a local advocate for the petition
Not useful as a substitute:
- A portal that “declares” heirs without a court or revenue process
- A family WhatsApp poll
Will-drafting sites (including Indian digital-will products) help before death. After death they can organise papers. They cannot invent a will.
Can I Use a Digital Will Service to Avoid Dying Intestate?
A digital service can help you stop being intestate if the output becomes a valid will.
For most non-Muslim wills governed by the Indian Succession Act formalities, that usually means:
- Capacity and free will
- Written instrument
- Signature
- Two witnesses who saw the signing (Section 63 style execution)
- Clear list of assets and beneficiaries
- Revocation of earlier wills if that is intended
The witnesses are not the kind of a login, an OTP and a PDF in the cloud. Some platforms put in video attestation or send a paper pack . Read what they do actually do.
Muslims still have a narrow testamentary power. The digital will giving away the entire estate still meets Shariat on the two-thirds.
NRI dual-will drafting (India immovables v foreign movables) is a separate drafting job. It is rare that one app template will satisfy both the lex situs and the foreign probate court.
Digital property (mail, photos, exchange keys) may need a DPDP-style nominee and a will clause. Even as courts have begun to recognise digital data as inheritable, platforms still require court orders if the user dies without a will.
Risk Analysis: Eleven Intestacy Traps
- Assuming the spouse takes 100 percent.
- Using a Hindu man’s Class I chart for a Hindu woman.
- Ignoring Section 15(2) source.
- Treating a nominee as the owner.
- Leaving an unsigned digital draft.
- One will that accidentally revokes an earlier foreign will.
- HUF property described as if it were the karta’s personal flat.
- Muslim estate planned as if 80C-style “full testamentary freedom” applied.
- Scheduled Tribe custom skipped.
- Heirs fighting while the bank freezes the only operating account.
- No guardian plan for a minor’s intestate share.
Table 2: Generic Advice vs. Strategic Thinking Matrix
| Decision Point | Generic Advice | Strategic Thinking |
| Wife died, no will | “Husband takes all” | Read her personal law and 15(1)/(2) |
| Parents of a childless daughter | “We are first” | Husband’s heirs may stand ahead on self-acquired assets |
| Bank nominee | “Matter closed” | Heirs can still claim |
| App will | “I have a will” | Witnesses and capacity |
| Hindu daughter | “Sons only” | 2005 amendment and Class I / 15(1) children |
| NRI son | “US will covers Pune flat” | Indian immovable often needs an Indian instrument |
Closing Perspective
Dying intestate is not a moral failing. It is a statutory presumption.” For a Hindu woman that default is Section 15, not her husband’s Class I list. The surviving husband has in common with the persons enumerated in the statute for a wife of any community. A clean exit is a valid will, current after marriage, divorce, the birth of a child and a property sale. Digital instruments can draw. They can’t be witnesses for you.
This is general information, not legal advice. The file is decided by personal law and asset title..
People Also Ask
What does dying intestate mean?
Dying without a valid will, so personal law distributes the estate.
If a wife dies intestate, who inherits?
Under Hindu law, children and the husband first. Under the Indian Succession Act, the husband typically shares with children (often one-third to the spouse). Under Muslim law, fixed Shariat shares. Never assume 100 percent.
How does Section 15 treat a female Hindu?
Children and husband; then husband’s heirs; then her parents. Inherited parental property can revert to the father’s heirs if she leaves no children.
Does a nominee become the owner?
No. Nomination is a receiving arrangement. Succession law still applies.
Can a digital will avoid intestacy?
Only if it is executed as a valid will. An unsigned cloud draft does not.
Where do I find legal help?
A local succession lawyer, legal services clinics, and the institution holding the asset. Online portals can organise documents.
Do daughters inherit on intestacy?
Yes for Hindu Class I and for a Hindu mother’s Section 15 first group. Christian children share equally. Muslim shares follow the school.
How can WealthMunshi help?
WealthMunshi offers succession-planning assistance, helping families to document a will and map intestate risk before a bank freeze.
Section 15 is a default. It is not a preference. If you want parents, a spouse or a child to take a different slice, you can schedule a succession review and execute a will that the statute will recognise.
