In the Netherlands, tax residency depends on your personal and economic situation, rather than how many days you are in the country. Your place of residence, the place where your family live, where you work and where you have economic interests may all be relevant in determining whether you are to be treated as a resident taxpayer. If you live in the Netherlands, you are generally deemed to be a resident taxpayer by the Dutch Tax Administration. If you live outside the Netherlands but have income from the Netherlands that the country is allowed to tax, you may be a non-resident taxpayer instead. As a general rule, when you leave the Netherlands, you will change from a resident taxpayer to a non-resident taxpayer. However, the exact treatment will depend on your circumstances. One of the first things to do is get your tax return sorted for the year you leave. If you were in the Netherlands only part of the year, you normally use the migration return, called the M form. This return can be filed on paper M form or online and is accepted by the Dutch Tax Administration. The maximum period of the 30% facility is generally five years for eligible employes, subject to the applicable rules and any reduction for previous Dutch residence or work. The benefit has also been cut since 2024. For the affected arrangements the maximum tax free percentage under the current structure is 30% for the first 20 months, 20% for the next 20 months and 10% for the final 20 months. The Dutch government has also announced plans for a partial reversal of the reduction from 2027 but timing is dependent on the legislative process.
